Welcome to HiDream.ai! This agreement outlines the terms and conditions of using the HiDream.ai software ("the Software") and services ("HiDream.ai Services" or "the Services") provided by HiDream.ai. It's important for you to read and understand the following content, especially the clauses related to the limitation or exclusion of HiDream.ai's liability, restrictions on user rights, and the choice of applicable law and jurisdiction. Clauses related to limitations, disclaimers, or other terms impacting your significant rights may be highlighted for your attention.

If you are under 18 years old or lack the legal capacity to engage in contractual activities, you should read this agreement under the guidance of your legal guardian ("Guardian") and only use HiDream.ai Services after obtaining your Guardian's consent. Both you and your Guardian are responsible for complying with this agreement and the consequences resulting from using HiDream.ai Services, as required by laws and regulations. If you are under 14 years old, before completing account registration, your Guardian should carefully read our dedicated "Children's Privacy Protection Statement." Only with your Guardian's agreement to the "Children's Privacy Protection Statement," can you use the Software and Services.

You are not authorized to use HiDream.ai Services unless you have thoroughly read, fully understood, and accepted all the terms of this agreement. If you disagree with this agreement or any of its terms, you must immediately cease using HiDream.ai Services. By clicking "Agree," using HiDream.ai Services, or expressing acceptance of this agreement in any explicit or implied manner, you indicate that you have read and agreed to this agreement. This agreement becomes legally binding between you and HiDream.ai and serves as a legally enforceable document for both parties.

This agreement also includes any additional agreements, operational rules, and related documents published by HiDream.ai concerning the use of HiDream.ai Services. Once officially published, these become an integral part of this agreement, and you are obligated to adhere to them.

1. Registration and Access

（1） HiDream.ai offers registration and login channels. Following the provided instructions, you can fill in information, read and accept this agreement, and upon completing the registration process, become a HiDream.ai user.

（2） The account you register and the password you set serve as credentials for logging in and using HiDream.ai Services. You must use them prudently and secure them properly. You are responsible for all activities and actions carried out with your account. Any unauthorized access, password loss, or account misuse due to inadequate safeguarding is your responsibility.

2. Usage Requirements

（1） According to the terms of this agreement, you have the right to access and use the Services non-exclusively. While using the Services, you agree to abide by this agreement, all applicable laws, and HiDream.ai's rights, ownership, and interests over the Services.

（2） We welcome feedback, comments, ideas, suggestions, and improvement proposals. If you provide any such content, we may use it without limitation and without providing compensation.

（3） You must not (i) use the Services in a manner that infringes, steals, or violates the rights of others; (ii) attempt to reverse engineer, decompile, disassemble, translate, or otherwise attempt to discover the source code or underlying components of the Service's models, algorithms, or systems, except where such restrictions conflict with applicable law; (iii) use the output of the Service to develop models competing with HiDream.ai; (iv) extract data or output from the Service using any automated or programming methods, including scraping, web collection, or web data extraction, except through authorized APIs; (v) mislead others when outputting results from the Service rather than human-generated content, or otherwise violate our usage policies; (vi) purchase, sell, or transfer API keys without our prior consent; and you must adhere to any rate limits and other requirements outlined in our documentation.

（4） Any third-party software, services, or other products used in conjunction with the Services are governed by their own terms, and we are not responsible for third-party products.

3. Content

（1） You can input information ("Input") to the Service and receive output ("Output") generated by the Service based on the Input. Input and Output together are referred to as "Content." Within the scope permitted by applicable laws, you retain ownership of all Input. Subject to your compliance with these terms, HiDream.ai grants you the right to use the Output. HiDream.ai may use Content to provide and maintain the Service, comply with applicable laws, and enforce policies.

（2） Artificial intelligence and machine learning are rapidly evolving fields. We continuously strive to improve our Services to make them more accurate, reliable, safe, and beneficial. Given the probabilistic nature of machine learning, using our Services may sometimes result in inaccurate outputs that do not accurately reflect real characters, locations, or facts. You should appropriately evaluate the accuracy of any Output based on your use case.

4. Service Fees

（1） You will pay all fees posted to your account according to the pricing page's terms and conditions or as otherwise agreed upon in writing between us. We reserve the right to correct pricing errors or mistakes, even if we have already issued an invoice or received payment. You are required to provide complete and accurate billing information, including a valid and authorized payment method. We will charge your payment method at the agreed-upon intervals, with reasonable adjustments to the billing date possible. You authorize HiDream.ai and our third-party payment processors to charge your payment method for fees. If we cannot complete your payment, we will send you a notification and may suspend your access to the Service until payment is received. Except where this agreement specifies otherwise, payments are non-refundable.

（2） We may change our prices by posting a notice to your account and/or our website, and such changes will take effect immediately. Any price changes will apply to fees charged to your account after the effective date of the change.

（3） You shall not create multiple accounts to benefit from free plans. If we suspect that you are using free plans dishonestly, we may charge you standard fees or suspend your access to the Services.

5. Guidelines for Content Creation

（1） The term "information content" as used in this agreement refers to any content you create, copy, publish, or disseminate while using the Service, also referred to as HiDream.ai product/platform information content.

（2） You understand and agree that HiDream.ai is committed to providing a civilized, healthy, and orderly online environment. You must not use HiDream.ai Services to create, copy, publish, or spread content that disrupts the normal operation of the service, violates laws and regulations, or infringes upon the legal rights of other users or third parties. You must not use HiDream.ai Services for any unlawful purpose.

（3） You understand and agree that your behavior on this platform must comply with relevant laws, regulations, and HiDream.ai platform policies. You must not engage in any illegal or improper activities, including but not limited to: a) Contravening the fundamental principles established in the constitution. b) Endangering national security, disclosing state secrets, subverting state power, or undermining national unity. c) Damaging national honor and interests. d) Inciting ethnic hatred, discrimination, or undermining ethnic unity. e) Instigating discrimination based on gender, region, etc. f) Undermining the state's religious policies, promoting cults, and feudal superstitions. g) Spreading rumors, disrupting social order, or disturbing social stability. h) Spreading obscenity, pornography, gambling, violence, murder, terrorism, or inciting criminal activities. i) Displaying content with sexual implications or innuendo. j) Insulting or defaming others, infringing upon their legitimate rights and interests. k) Using exaggerated headlines that significantly deviate from the content. l) Inappropriately commenting on natural disasters, major accidents, and disasters. m) Distorting, vilifying, profaning, or denying heroic deeds and spirits, and insulting, defaming, or otherwise harming the names, images, reputations, and honors of heroes and martyrs. n) Promoting terrorism, extremism, or inciting acts of terrorism or extremism. o) Displaying blood, gore, horror, or other content causing physical and mental discomfort. p) Content not conforming to socialist system, national interests, citizens' legitimate rights and interests, public order, social moral standards, and information authenticity. q) Violating laws, regulations, rules, ordinances, and other normative documents of China or any other country or region.

（4） If your use of HiDream.ai Services' network services for uploading, creating, transmitting, or otherwise disseminating content infringes upon the legitimate rights and interests of third parties (including but not limited to patent rights, trademark rights, copyrights and neighboring rights, portrait rights, privacy rights, reputation rights, etc.), causing HiDream.ai to face any complaints, reports, inquiries, claims, lawsuits, or any loss of reputation, reputation, or property damage, you must actively take all possible measures to ensure that HiDream.ai is not affected by the aforementioned complaints or lawsuits. Meanwhile, you are fully liable for any direct and indirect economic losses suffered by HiDream.ai due to this.

（5） Your actions of publishing content, sharing, forwarding, or copying HiDream.ai product and related service information content to any third party must also adhere to the other norms and standards set by the company.

（6） In order to promote healthy development of internet content, all your actions on HiDream.ai Services should comply with the bottom lines of laws, regulations, socialist system, national interests, citizens' legitimate rights and interests, social public order, and moral standards. You must be responsible for all actions under your registered account, including any content you publish and the consequences thereof. You must exercise your own judgment regarding the content in this Service and assume all risks arising from using the content, including risks related to the legality, accuracy, completeness, or usefulness of the content. HiDream.ai cannot and will not be held liable for any losses or damages arising from the aforementioned risks.

6. Limitation of Liability and Exemption

（1） [Limitation of Liability] All disclaimers and limitations of liability in this agreement apply only to the extent permitted by applicable laws and regulations.

（2） [Platform Responsibility] HiDream.ai assumes platform responsibility in accordance with relevant laws and regulations. We are not responsible for third-party defamation, crimes, or other illegal activities, and we do not compensate for any losses incurred as a result. This excludes instances where HiDream.ai bears legal responsibility for harm you have suffered.

（3） [Service Changes, Interruptions, Termination]

• HiDream.ai continuously evolves and improves its Services. We make every effort to provide continuous and secure services. Accordingly, we may update HiDream.ai. You should keep the software up-to-date to ensure normal use of HiDream.ai.

• You understand and agree that HiDream.ai may suspend, interrupt, or terminate part or all of HiDream.ai Services due to its business decisions, government actions, force majeure, etc. In such cases, we will notify you reasonably and within a reasonable timeframe, except as otherwise stipulated by laws and regulations. We are not liable for any losses resulting from such actions, except where required by law.

• In the event of a merger, division, acquisition, or asset transfer involving HiDream.ai, we may, after notifying you, transfer part or all of HiDream.ai Services and corresponding rights and obligations to a third party for operation or fulfillment. The specific transferee will be subject to HiDream.ai's notification.

• HiDream.ai reserves the right to suspend or terminate the provision of services to you without prior notice in the event of the following circumstances: o You provided false information or information inconsistent with your registration when the law and regulations require you to provide truthful information, and you failed to provide reasonable proof. o You violated relevant laws and regulations or the provisions of this agreement. o Pursuant to the requirements of laws and regulations or judicial authorities or competent authorities. o For security reasons or other necessary circumstances.

（4） You understand and agree that this software, like most internet software, may be affected by various factors, including but not limited to user actions, network service quality, social environment, and security issues. It may also be vulnerable to various security problems, including but not limited to illegal use of user information by others for real-life harassment, viruses, trojans, or other malicious programs in software downloaded and installed by users, or on websites accessed by users, threatening the security of terminal equipment information and data, thereby affecting the normal use of this software. Maintaining software security and normal use is a shared responsibility. HiDream.ai will reasonably and prudently take necessary technical measures to protect your terminal equipment information and data security according to industry standards. However, you acknowledge and agree that HiDream.ai cannot provide an absolute guarantee in this regard.

（5） Any disputes arising from the use of third-party software or technology used in connection with this software or service are the responsibility of the third party to resolve. HiDream.ai assumes no responsibility for this and does not provide customer support for third-party software or technology.

7. Additional Terms and Legal Jurisdiction

（1） HiDream.ai reserves the ultimate right of interpretation of all the terms contained in this agreement, within the limits permitted by law.

（2） This agreement takes effect once published, and your use of the Service indicates your reading and acceptance of the terms of this agreement. HiDream.ai has the right to modify the content of the agreement at any time. After any modification to the agreement's terms, if you do not agree to the modified terms, you have the right to stop using the network services. If you continue to use the network services, it is considered that you accept HiDream.ai's modifications to the relevant terms of the agreement. If you do not accept the modified agreement, you should stop using this software and service.

（3） HiDream.ai is the intellectual property right holder of this software. All copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights of this software, as well as all information content related to this software (including but not limited to text, images, audio, video, charts, interface design, layout framework, relevant data, or electronic documents, etc.), are protected by the laws and regulations of the People's Republic of China and relevant international treaties, and HiDream.ai holds the above-mentioned intellectual property rights except for the rights that the relevant rights holders should enjoy according to law.

（4） The place of conclusion of this agreement is Haidian District, Beijing, People's Republic of China.

（5） Except as otherwise stipulated, this agreement's conclusion, execution, interpretation, and dispute resolution shall be governed by the laws of China (excluding conflict of laws) and subject to the jurisdiction of Chinese courts (only for the purpose of this clause, excluding the Hong Kong Special Administrative Region, Macao Special Administrative Region, and Taiwan).

（6） In case of any discrepancy or inconsistency between the Chinese language version of this agreement and versions in other languages, the Chinese version shall prevail.
